These Terms of Service (“Terms”) govern access to and use of the Aurum Brew website, online store, products, content, accounts, and related services. By accessing the website, creating an account, or purchasing a product, you agree to these Terms and the policies referenced in them.

1. Eligibility

You must be at least the age of majority in your jurisdiction or use the services with the permission and supervision of a parent or legal guardian. You may use the services only for lawful purposes and in compliance with applicable laws.

2. Online Store Platform

Our store is hosted by Shopify. Shopify provides the commerce technology used to display products, operate checkout, process certain information, and support transactions. Your use of certain Shopify features may also be governed by Shopify’s terms and privacy practices.

3. Products and Product Information

We make reasonable efforts to describe and display products accurately. However:

• Screen settings may affect how colors appear.
• Ceramic, textile, agricultural, and printed products may have natural or production-related variation.
• Coffee flavor notes describe expected sensory characteristics and are not added flavors or guarantees of an identical experience.
• Coffee flavor may vary because of harvest, age, grinding, water, equipment, storage, and brewing technique.
• Product photographs may include props not included with the purchase.
• Measurements and weights may have reasonable manufacturing tolerances.

We may modify, discontinue, limit, or replace products without notice.

4. Coffee and Food Information

Customers are responsible for reviewing product descriptions and determining whether a product is appropriate for them. Information about coffee, brewing, caffeine, wellness, or lifestyle is provided for general informational purposes. It is not medical, nutritional, or professional advice. Contact an appropriate professional regarding personal medical conditions, sensitivities, pregnancy, medication interactions, or caffeine consumption.

5. Prices, Promotions, and Taxes

Prices are shown in the currency selected or presented by the store and may change without notice.

Applicable shipping charges, taxes, duties, and other charges are displayed or calculated when reasonably possible. Customers are responsible for taxes, duties, customs charges, and fees not collected during checkout. Discounts, bundles, promotions, and free-shipping offers:

• May have separate conditions.
• May be modified or ended.
• May not be combined unless expressly permitted.
• Have no cash value.
• May be limited by customer, household, order, product, or date.

Unless a different promotion is expressly stated, an eligible United States order with a merchandise subtotal over $45 receives free flat-rate standard shipping only. Express, expedited, priority, overnight, or other upgraded shipping services remain paid at the checkout rate. Obvious pricing, discount, or listing errors do not require us to complete an order at the erroneous price.

6. Orders

Submitting an order is an offer to purchase. An order-confirmation email acknowledges receipt but does not necessarily constitute final acceptance. We may accept, reject, limit, hold, or cancel an order for reasons including:

• Product unavailability.
• Pricing or description errors.
• Payment problems.
• Suspected fraud.
• Shipping restrictions.
• Quantity limitations.
• Suspected unauthorized resale.
• Inability to verify information.
• Events outside our reasonable control.

If we cancel a paid order, we will issue the applicable refund to the original payment method.

Customers represent that:

• They will pay all authorized charges.

Payment processing is performed by third-party providers. We are not responsible for delays or errors caused solely by a customer’s financial institution or payment provider.

8. Shipping and Delivery

Shipping, processing, tracking, customs, address errors, lost packages, and delivery issues are governed by our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise.

Customers must provide complete and accurate shipping information and monitor tracking. If we cannot ship within a timeframe we expressly promised, we will provide notice and available options as required by applicable law.

9. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, damaged products, and non-returnable products are governed by our Refund and Return Policy. Coffee and other consumable products generally cannot be physically returned. Eligible unused merchandise may qualify for return under the stated conditions. Nothing in these Terms limits non-waivable rights provided by applicable consumer-protection law.

10. Cancellations, Preorders, and Subscriptions

Order cancellations and changes are governed by our Cancellation Policy. When subscriptions or preorders are offered, their price, frequency, renewal, expected timing, and cancellation terms will be disclosed before purchase. Canceling a subscription normally affects future renewals and does not automatically cancel an order already processed.

11. Customer Accounts

Customers are responsible for:

• Keeping login credentials confidential.
• Providing accurate account information.
• Restricting unauthorized access to their devices.
• Notifying us of suspected account misuse.

We may suspend or close an account used fraudulently, unlawfully, abusively, or in violation of these Terms.

12. Intellectual Property

The website and its contents - including the Aurum Brew name, logos, product names, artwork, photographs, graphics, packaging, text, layouts, videos, recipes, and designs - are owned by or licensed to Aurum Brew and are protected by applicable intellectual-property laws. Except for ordinary personal, noncommercial use of the website, no content may be copied, reproduced, modified, distributed, sold, displayed, scraped, or commercially exploited without prior written permission. Purchasing a product does not transfer ownership of any trademark, copyright, artwork, or design.

13. Reviews and Customer Content

When you submit a review, photograph, comment, testimonial, tag, or other content, you represent that:

• You created it or have permission to use it.
• It is truthful and not misleading.
• It does not violate another person’s rights.
• It does not contain unlawful, threatening, defamatory, discriminatory, obscene, fraudulent, or malicious material.

You grant Aurum Brew a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and share submitted content in connection with our business and marketing, subject to applicable law. We may remove content but are not obligated to monitor every submission.

To the fullest extent permitted by law, Aurum Brew and its owners, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the services or products.

Where liability cannot lawfully be excluded, our aggregate liability will not exceed the amount paid for the specific product or transaction giving rise to the claim, unless applicable law requires a different result. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.

19. Indemnification

To the extent permitted by law, you agree to reimburse and hold Aurum Brew harmless from third-party claims, liabilities, or reasonable expenses resulting from your unlawful conduct, infringement of another person’s rights, misuse of the services, or material violation of these Terms.

20. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to applicable consumer rights and jurisdictional requirements, disputes may be brought in the state or federal courts serving King County, Washington. Customers may retain mandatory rights under the laws of their place of residence.

21. Severability

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

22. No Waiver

Failure to enforce a provision is not a waiver of the right to enforce it later.

23. Entire Agreement

These Terms and the policies referenced in them constitute the agreement governing use of the services, except where separate written terms apply.

24. Changes to These Terms

We may update these Terms to reflect changes in the services, business practices, or law. The revised Terms will be posted with an updated date. Continued use after the effective date constitutes acceptance to the extent permitted by law.
